TERMS AND CONDITIONS FOR COMPETITIONS

By performing the specific action(s) specified in the respective competition post on the organiser's social media page, the participant agrees to the terms and conditions for competitions.


1.    Organizer
The organiser of the competitions is Arcadia Live GmbH, Porzellangasse 7A, 1090 Vienna.


2.    Eligibility
Participation in the competition is free of charge. Participants must be at least 14 years old and have their main residence in Austria. Persons involved in the design and implementation of the competition, as well as their family members and members of their household, are excluded from participation.
The organiser reserves the right to exclude participants, revoke or reclaim prizes already awarded and select replacement winners if there is suspicion of manipulation or other improper or unfair means affecting the chances of winning, or if there are other justified concerns.
The participant expressly declares that the personal details and other information provided during registration are correct. Participation under a false name and/or using the details of third parties is not permitted.
Each participant may only enter the same competition once. Therefore, participation using different email addresses, postal addresses and/or social media profiles is not permitted.


3.    Conducting the competition
The competition begins on 1 December 2025 at 7:00 a.m. and ends on 31 December 2025 at 2:00 p.m. (‘competition period’). 
The organiser will publish a separate competition post on its social media page (Facebook and/or Instagram) for each day from 1 December 2025 to 24 December 2025. Each competition post will publish the prizes, the actions required to participate and any additional information for the respective competition post.
All participants who complete the action(s) specified in the respective competition post will take part in a competition on the organiser's social media page. Participants are only eligible to take part in the competition if all the requirements specified in the respective competition post are met. Fulfilment of the requirements only entitles participants to take part in the winner selection for the respective competition post on a given day.


4.    Prizes
The prizes specified in the respective competition entry will be raffled off among all participants.


5.    Determination and notification of winners
The winner will be determined by random draw in private. The draw will take place on the following day at 2 p.m. for each competition entry published on a specific date during the competition period. For example, the draw for the competition post dated 1 December 2025 will take place on 2 December 2025 at 2 p.m. An exception to this rule is 24 December 2025. In this case, the draw will take place on 31 December 2025 at 2 p.m.
The winner will be notified of their prize via direct message to their social media profile. 
The winner must confirm acceptance of the prize within 48 hours of being notified. The winner must provide the organiser with the necessary information for collecting the prize (e.g. name for ticket reservations or postal address for sending the prize). 
If the deadline for accepting the prize announced by the organiser expires without result or if the winner fails to provide the necessary information, the prize claim shall lapse. In this case, the organiser reserves the right to determine a new winner using the same procedure. There is no obligation to accept the prize.
If the contact details provided by the participant are incorrect (e.g. name, social media profile, email address or postal address), the organiser is not obliged to search for the correct details. Any disadvantages resulting from the provision of incorrect contact details shall be borne by the participant. This shall only apply if the organiser has not acted intentionally.
The winner will be informed of the collection location and/or method of delivery of the prize in the competition post on the organiser's social media page and/or via direct message to their social media profile.
The prize claim is non-transferable. By participating in the competition, the participant is not obliged to purchase a product, nor will they incur any costs. Participation in the competition is free of charge and independent of the purchase of goods and services. The chances of winning are not influenced by any performance on the part of the participant.
Legal recourse is excluded. Cash redemption or exchange of the prize is not possible. The organiser reserves the right to change or supplement the conditions of participation without prior notice, insofar as this is necessary in the interests of simple and secure processing and, in particular, to prevent abuse or in any other way. The organiser also reserves the right to cancel a competition during the participation period.


6.    Final provisions
The organiser shall only be liable for damages caused by intent. This limitation of liability shall not apply to damages resulting from injury to life, limb or health of persons and to claims under the Product Liability Act. Furthermore, the limitation of liability shall also not apply to the breach of primary contractual obligations.
In the event of legal disputes, the law of the Republic of Austria shall apply exclusively, excluding conflict of law provisions.

PRIVACY POLICY FOR COMPETITIONS

1. Who is responsible for handling your data?
1.1. ARCADIA LIVE GmbH, Porzellangasse 7a, 1090 Vienna, telephone number: +43 (0) 1 958 05 05, e-mail address: office@arcadia-live.com (‘ARCADIA’, ‘we’, ‘us’) is responsible for adequately protecting your personal data. ARCADIA therefore complies with all legal provisions on the protection, lawful handling and confidentiality of personal data, as well as on data security.
1.2. We process your personal data as required by the General Data Protection Regulation (GDPR), the Data Protection Act (DSG) and all other relevant laws.

2. What interest does ARCADIA have in your data and for what reason and for what purpose may ARCADIA process it?
2.1. For participation in the competition, we process the following data from you (depending on the specific design): Name, age, name of the social media profile, your activities on our social media profile (e.g. a like or comment), e-mail address and postal address. The processing is carried out in accordance with Art. 6 para. 1 lit b GDPR for the execution of the competition (and thus fulfilment of the contract) and for the purpose of pre-contractual measures. The storage and processing of the data is necessary in order to organise the competition and to inform you of any winnings.
2.2. If you win, your name and, if applicable, a photo of you may be published on our social media profiles and our website. The processing is carried out in accordance with Art 6 para 1 lit f GDPR on the basis of our legitimate interests in the announcement of the winner and general marketing measures.

3. How long will your data be stored?
We process your personal data from point 2 for as long as it is necessary to process the competition and delete it within seven days of the end of the competition, unless this data must be stored beyond this period as part of statutory retention obligations. We process the winner's data for six months and beyond if we publish the data on the basis of our legitimate interests described above.

4. To whom may we disclose your data? 
4.1. The data will only be passed on to other third parties if this is necessary to fulfil (pre)contractual or legal obligations or is justified to protect our legitimate interests. For example, we transfer your personal data to external third parties to the extent necessary, e.g. shipping companies, auditors, insurers or legal representatives.
4.2. Your data may be transferred to contracted service providers (e.g. IT service providers and other service providers for processing the competition) for order processing.
 

5. What rights do you have?
5.1. If you wish, we will provide you with information about all your personal data that we process at any time. In some cases, you also have the right to data portability, i.e. to receive the personal data you have provided to us in a structured, commonly used and machine-readable format. 
5.2. Under certain circumstances, you may request the restriction of processing, rectification and erasure of your personal data.
5.3. In some of the cases mentioned above, ARCADIA is authorised to process your personal data on the basis of your voluntary consent. You can revoke this consent at any time without giving reasons with effect for the future, until then we will process your data lawfully.
5.4. Would you like to make a complaint? In this case, you can contact us via the data protection officer named under point 1.3. You also have the right to lodge a complaint with the Austrian Data Protection Authority, Barichgasse 40-42, 1030 Vienna.
If we process your data in the interests of ARCADIA or a third party, you also have the right to object at any time if there are grounds relating to your particular situation.
